The Colorado Supreme Court said Monday it will review a challenge to Breckenridge's regulatory fee on short-term rental licenses, a case that raises a question the court has not addressed before.
The dispute centers on whether the mountain town can charge property owners a fee when they apply for or renew a license to operate a short-term rental. The owner challenging the fee argues the charge goes beyond what local governments may lawfully impose, while the town maintains the fee covers the cost of administering its rental program.
Justices accepted the case as a matter of first impression, meaning the state's highest court has not previously ruled on the specific legal issue involved. That makes the outcome potentially significant for other Colorado communities that have adopted similar licensing systems in recent years.
Breckenridge, like several resort towns across the state, began requiring short-term rental licenses as a way to track inventory and address housing concerns. The fees attached to those licenses have drawn increasing scrutiny from owners who say the costs are excessive and amount to an unlawful tax rather than a legitimate regulatory charge.
A ruling from the Supreme Court could clarify how far municipalities can go in charging rental owners and set a standard for how such fees are calculated and justified. No date has been set for arguments.
