Tax Court Nod To Income Approach Props Easement Valuation

The U.S. Tax Court has issued a decision that strengthens the position of taxpayers who rely on the income approach to value conservation easements. The ruling came in a case involving a donated property in the Los Angeles area, where the court accepted the method as a valid way to determine the worth of the easement.

For years, the IRS has challenged taxpayers who use the income approach, arguing that it can produce inflated deductions. The agency often prefers other valuation methods, such as comparable sales, and has frequently disputed easement appraisals in court. This decision, however, signals that the income approach carries legitimate weight when properly applied.

The case centered on a property donated for conservation purposes. The taxpayer used the income approach, which bases value on the potential income the land could generate, to calculate the deduction. The IRS rejected that figure, but the Tax Court sided with the taxpayer's methodology.

The ruling does not give blanket approval to every income based appraisal. It still requires sound analysis and credible assumptions. Even so, the decision offers a measure of relief to donors and appraisers who have faced pushback from the IRS. It also adds to a growing body of case law shaping how conservation easement deductions are reviewed.
